		<description>I am more worried that Dalriada can supposedly access our pension funds to pay any incurred costs without consent or authority.
Has anyone given Dalriada consent or authority to access their pension funds (email to: PaulGrant@cossie.force9.net)?
I am totally against this as I have given no consent or authority and if any of my funds are used I will be pursuing Dalriada via court proceedings (and I advise everyone to do the same  - email me for further information).
Note that ARK are bearing their own legal costs.</description>

		<description>I Totally agree Phillip  everyone that entered the schemes new the risks , but needed the cash. how can the scheme members be at fault for a company like Ark that still maintain the legality of their schemes, I just want my whole pension back , and will fight to the letter anyone who skims off my pension.
How is it so difficult to access my pension and other people can seem to be helping themselves , so much for a pension regulator they are all out to rip us all off .</description>

Dalriada appreciates that a number of people have elected to transfer benefits into one of the Ark Schemes with the expectation of obtaining an MPVA payment.
However, as we have stated on our website page for members – http://www.dalriadatrustees.co.uk/ark/, Dalriada has been advised by a leading barrister (a Queen’s Counsel or “QC” who specialises in pensions and trust law matters) that there is a strong possibility that MPVA payments are “void”. Dalriada will seek Court direction on whether this is the case.
If the Court decides that MPVAs are “void” we will be required to seek repayment of the money. As such, it would be inappropriate for Dalriada to continue to make MPVA payments at the current time.
Whilst such legal questions remain to be answered it is difficult to give members definitive answers to certain questions and, also, how the Ark Schemes will run in the future. Dalriada appreciates this is frustrating for members and is endeavouring to move things forward as quickly as possible.
Dalriada will update the website page for Ark members when it is able and would ask members to check periodically for updates. Alternatively, Dalriada can be contacted as shown on that website page.”</description>
